Compensation funds are used in vastly different ways across jurisdictions and legal traditions. They are an alternative to traditional tort, insurance and social security structures, and change or eliminate ordinary liability rules for certain classes of victims. Compensation funds have been established to solve liability problems in the domains of traffic accidents, financial deposits, crime victim redress, industrial and environmental damage, natural disasters and healthcare damage. They are popular with lawmakers, but their undefined nature (and sometimes incoherent status) raises important legal questions that have not yet been fully answered.The way that compensation funds have developed in different jurisdictions has not always been consistent with the rest of the legal system within that jurisdiction. Britt Weyts is gewoon hoogleraar aan de Universiteit Antwerpen. Zij doceert ‘Verbintenissenrecht’ en ‘Verzekeringsrecht’. Haar proefschrift “De fout van het slachtoffer in het buitencontractueel aansprakelijkheidsrecht” werd bekroond met de prestigieuze Fernand Collin-Prijs 2004. Zij is advocaat in het kantoor Verbist & Vanlerberghe Omega Law. Zij is ook auteur van het Handboek Buitencontractueel Aansprakelijkheidsrecht en editor van het Handboek Verzekeringsrecht (telkens samen met Thierry Vansweevelt).
Vansweevelt, Thierry
Thierry Vansweevelt is gewoon hoogleraar aan de Universiteit Antwerpen. Hij doceert ‘Aansprakelijkheidsrecht en risicoverzekeringen’ en ‘Gezondheidsrecht’. Zijn proefschrift “De
civielrechtelijke aansprakelijkheid van de arts en het ziekenhuis” werd bekroond met de prestigieuze Fernand Collin-Prijs 1992. Voor zijn gehele oeuvre ontving hij de Prijs Onderzoeksraad Universiteit Antwerpen. Van 2003 tot 2006 was hij Decaan van de Faculteit Rechten. Hij is advocaat-partner in het kantoor Dewallens & partners. Hij is ook auteur van het Handboek Buitencontractueel Aansprakelijkheidsrecht en editor van het Handboek Verzekeringsrecht (telkens samen met Britt Weyts).
