In this volume, the 3rd issue of the Proceedings of the 24th IVR World Congress, the reader will find a selection of papers on the general theme of "The Philosophy of Precedent". The foundations, legal nature, structure, strength and uses of the case law were vividly debated at two special workshops dedicated to the study of legal precedent by a large number of scholars from around the world. The attention that the theme received at the congress indicates a trend of growing interest on the topic of precedent among legal philosophers, legal theorists and practitioners from all of the legal families and traditions, including those of the so-called Civil Law Systems. Taking into consideration this movement towards the universality of precedent-based reasoning in legal discourses, the essays comprised in this volume provide an account of legal precedent which explains the connections between theoretical issues on the nature of precedent and practical queries over its foundations, structure, strength and uses in contemporary legal systems.

Bustamante, Thomas
Thomas da Rosa Bustamante is a Bachelor of Laws (Universidade Federal de Juiz de Fora), Master of Philosophy of Law (Universidade do Estado do Rio de Janeiro) and Doctor of Philosophy of Law (Pontifícia Universidade Católica do Rio de Janeiro). He is also a professor at the Universidade Federal de Minas Gerais Law School.

Thomas Bustamante is a Tenured Adjunct Professor at the Federal University of Minas Gerais (Universidade Federal de Minas Gerais), in Brazil, and holds a PhD from the Pontifical Catholic University of Rio de Janeiro, in the same country. He has previously been part of the Academic Staff of the University of Aberdeen, in the UK, where he still holds an honorary appointment, and of the Federal University of Juiz de Fora (Universidade Federal de Juiz de Fora), in Brazil, where he is also a research fellow.

Carlos Bernal Pulido is a senior lecturer at Macquarie Law School (Sydney, Australia). He has research interests in the fields of jurisprudence, torts, theory of action and constitutional theory. His qualifications include a LL.B. from the University Externado of Colombia (Bogota) (1996), a S.J.D. from the University of Salamanca (Spain) (2001) and a M.A. (2008) and a Ph.D. in Philosophy (2011) from the University of Florida (U.S.A).
